Terms and Conditions

Terms and Conditions ("Terms") form a legally binding agreement between you and Cooky ("we", "our", or "us") and govern your use of the Cooky mobile application ("App") and related services ("Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

Certain features of the Services may be subject to additional guidelines, rules, or policies posted within the Services. Those additional terms are incorporated into these Terms by reference.

1. Accounts

1.1 Account Creation

To access certain features of the Services, you may be required to create an account ("Account") and provide information such as your email address or login credentials.

By creating an Account, you represent and warrant that:

• The information you provide is accurate and complete
• You will keep your information updated
• You are at least 18 years of age or the age of majority in your country

1.2 Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account.

You agree to notify us immediately if you suspect unauthorized access to your Account.

2. Access to the Services

2.1 Permission to Use

Subject to these Terms, we grant you a limited, non exclusive, non transferable, revocable license to access and use the Services for personal, non commercial purposes.

2.2 Restrictions

You agree not to:

• Copy, distribute, or commercially exploit the Services
• Reverse engineer, decompile, or attempt to extract source code from the App
• Use the Services to create a competing product or service
• Interfere with or disrupt the Services

2.3 Modifications

We reserve the right to modify, suspend, or discontinue the Services at any time, with or without notice.

2.4 Ownership

All intellectual property rights related to the Services, including the App, software, branding, and content (excluding User Content), remain the property of Cooky or its licensors.

3. Subscriptions and In App Purchases

3.1 Subscription Based Features

Certain features of the Cooky App require a paid subscription (for example Cooky Pro or other premium tiers).

Subscription features may include:

• Expanded recipe collections
• Advanced meal planning tools
• Unlimited cookbooks
• Priority support
• Other premium functionality

The specific features included in each subscription tier are described in the App.

3.2 Subscription Terms

By purchasing a subscription, you agree to the following:

Eligibility

You must be at least 18 years of age and have a valid payment method associated with your Apple ID.

Billing Cycle

Subscriptions may be offered monthly, annually, or other billing periods presented at purchase.

Auto Renewal

Subscriptions automatically renew unless cancelled before the end of the current billing period. The renewal charge will occur within 24 hours before the end of the current period.

Payment

Payment is charged to your Apple ID account at confirmation of purchase.

Access

Subscription features are available during the active billing period.

3.3 Free Trials

Cooky may offer free trial periods for new subscribers.

If you start a free trial:

• You will not be charged until the trial period ends
• Your subscription will automatically convert to a paid subscription unless cancelled before the trial ends
• You may cancel through your Apple device subscription settings

3.4 Cancellation and Refunds

You may cancel your subscription at any time through your device subscription settings.

Cancellation takes effect at the end of the current billing period.

All subscription payments are processed by Apple. Cooky does not process payments directly and cannot issue refunds.

3.5 Price Changes

We may change subscription prices at any time.

If prices increase:

• You will be notified in advance
• The new price will apply at the next billing cycle
• You may cancel before the new price takes effect

3.6 Lapse of Subscription

If your subscription lapses due to cancellation or payment failure, access to subscription features will end at the end of the billing period.

You may reactivate your subscription at any time.

4. User Content

4.1 User Content

The Services may allow users to upload or share recipes, photos, comments, or other materials ("User Content").

You are solely responsible for any User Content you submit.

4.2 License to Use Content

By submitting User Content, you grant Cooky a worldwide, non exclusive, royalty free license to use, reproduce, display, and distribute that content within the Services.

This license allows us to operate and improve the platform.

4.3 Content Rules

You agree not to submit content that:

• Violates intellectual property rights
• Is illegal or harmful
• Contains harassment or abusive material
• Violates the rights of others

4.4 Content Moderation

Cooky reserves the right, but is not obligated, to review or remove User Content that violates these Terms.

5. Third Party Services

The Services may contain links to third party services or integrations.

Cooky is not responsible for the content, policies, or practices of third party services.

6. Recipes and Food Information Disclaimer

Recipes and cooking instructions provided through the Services are for informational purposes only.

Many recipes may be submitted by users and may not be reviewed prior to publication.

Cooky does not guarantee the accuracy or safety of any recipe.

Users should exercise their own judgment when preparing food, including checking ingredients for allergens and following proper food safety practices.

7. AI Generated Content

Some features of the Services may use artificial intelligence to generate recipes, suggestions, or cooking instructions.

AI generated content is provided for informational and creative purposes only.

Cooky does not guarantee that AI generated content will be accurate, complete, or suitable for your dietary needs.

Users are responsible for reviewing and verifying any generated content before using it.

8. Nutrition and Health Disclaimer

The Services may include information related to nutrition, ingredients, or dietary preferences.

This information is provided for general informational purposes only and should not be considered medical or nutritional advice.

Users should consult qualified health professionals before making dietary changes.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind.

To the fullest extent permitted by law, Cooky disclaims all warranties including merchantability, fitness for a particular purpose, and non infringement.

We do not guarantee that the Services will always be available, secure, or error free.

10. Limitation of Liability

To the maximum extent permitted by law, Cooky shall not be liable for indirect, incidental, special, consequential, or punitive damages including loss of data, profits, or use arising from use of the Services.

11. Termination

11.1 Termination by You

You may stop using the Services or delete your account at any time.

11.2 Termination by Us

We may suspend or terminate your access if:

• You violate these Terms
• We are required to do so by law
• Continued operation becomes impractical

11.3 Effect of Termination

Upon termination, your right to access the Services immediately ends.

12. Availability of the Services

We do not guarantee that the Services will be uninterrupted or error free.

The Services may be unavailable due to maintenance, updates, technical issues, or third party disruptions.

13. Export Compliance

You agree to comply with all applicable export laws and regulations when using the App.

The App may not be exported or used in violation of applicable export restrictions.

14. Consumer Rights

Nothing in these Terms limits any rights that cannot be excluded under applicable law.

If you are located in Australia, protections may apply under the Australian Consumer Law.

15. App Store Terms

If you downloaded the App from the Apple App Store:

These Terms are between you and Cooky only, not Apple Inc.

Apple is not responsible for the App or its content.

Cooky is solely responsible for the App and Services.

Apple has no obligation to provide maintenance or support services.

Apple and its subsidiaries are third party beneficiaries of these Terms.

Use of the App must comply with the Apple Media Services Terms and Conditions.

16. Intellectual Property Claims

If you believe content available through the Services infringes your intellectual property rights, please contact us with details of the claim.

Cooky may remove allegedly infringing content and suspend repeat offenders.

17. Community Guidelines

Users must interact with the Services respectfully and lawfully.

Prohibited behavior includes harassment, abusive conduct, misleading content, intellectual property violations, impersonation, or spam.

Cooky may remove content or restrict accounts that violate these guidelines.

18. Changes to These Terms

We may update these Terms from time to time.

If significant changes occur, users may be notified through the App or website.

Continued use of the Services after updates constitutes acceptance of the revised Terms.

19. Governing Law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles.

20. Electronic Communications

By using the Services, you consent to receive communications electronically, including notices about your account or updates to these Terms.

21. Entire Agreement

These Terms constitute the entire agreement between you and Cooky regarding your use of the Services.
